The cap was s<a href=\"https:\/\/www.politico.com\/news\/2026\/08\/06\/fcc-plows-ahead-with-scrapping-tv-ownership-cap-01027287\">et by Congress at 39 percent in 2004<\/a> amid concerns over market concentration.<\/p>\n<p data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmshozk9i000x27qh4ux8hbld@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">Reactions to the FCC order were mixed. The <a href=\"https:\/\/www.nab.org\/documents\/newsRoom\/pressRelease.asp?id=7533\">National Association of Broadcasters said<\/a>:<\/p>\n<blockquote>\n<p data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmshozk9i000x27qh4ux8hbld@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\u201cThe FCC\u2019s decision to eliminate the outdated national television ownership cap marks a generational step toward strengthening local stations and ensuring they can compete in today\u2019s media marketplace. We applaud Chairman Carr and the Commission for recognizing that rules adopted decades ago should not constrain local broadcasters\u2019 ability to invest in journalism, innovation and service to their communities. Today the FCC helped level the playing field and strengthen local stations\u2019 ability to deliver the trusted news and emergency information millions of Americans rely on.\u201d<\/p>\n<\/blockquote>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmshozk9i000x27qh4ux8hbld@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">It was &#8220;a big win to media companies aligned with President Donald Trump and the Republican Party,&#8221; <a href=\"https:\/\/www.cnn.com\/2026\/08\/06\/media\/fcc-carr-repeals-national-tv-ownership-cap-trump\">said CNN<\/a>.\u00a0 The longstanding cap on market reach was designed to limit the consolidation of broadcast television, a<a href=\"https:\/\/www.theguardian.com\/media\/2026\/aug\/06\/fcc-overturns-limit-local-tv-ownership\">ccording to the Guardian<\/a>.<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmshp2lcp00023b6ruyza5971@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">The decision will probably be challenged in court with the argument that only Congress has the authority to change this area of the law.\u00a0 The &#8220;scarcity rationale&#8221; for regulations over the structure (not the content) of\u00a0 broadcasting has been seen as undermined by new technologies.
