{"id":7331,"date":"2026-02-17T14:53:23","date_gmt":"2026-02-17T14:53:23","guid":{"rendered":"https:\/\/revolutionsincommunication.com\/law\/?p=7331"},"modified":"2026-02-18T19:19:24","modified_gmt":"2026-02-18T19:19:24","slug":"more-colbert-censorship","status":"publish","type":"post","link":"https:\/\/revolutionsincommunication.com\/law\/2026\/02\/17\/more-colbert-censorship\/","title":{"rendered":"More censorship for the Late Show"},"content":{"rendered":"<p><iframe loading=\"lazy\" style=\"border: none; overflow: hidden;\" src=\"https:\/\/www.facebook.com\/plugins\/video.php?height=314&amp;href=https%3A%2F%2Fwww.facebook.com%2Freel%2F1199125752205396%2F&amp;show_text=false&amp;width=560&amp;t=0\" width=\"460\" height=\"290\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><br \/>\n<strong>In a new interpretation of longstanding rules <\/strong><a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DA-26-68A1.pdf\">\u00a0released Jan. 21, 2026<\/a>,\u00a0 the Trump administration&#8217;s Federal Communications Commission said that<a href=\"https:\/\/en.wikipedia.org\/wiki\/Equal-time_rule\"> Section 315\u00a0 &#8220;Equal Time Rule&#8221;\u00a0<\/a> requirements for news talk programs are in effect unless there is an exemption, which Stephen Colbert does not have.<\/p>\n<p>Under the rule, broadcast media must provide equal time for all politicians running for the same office. If an interview is aired with a democratic candidate for an office,\u00a0 a similar interview with republican and independent candidates\u00a0 must also be aired.<\/p>\n<p>The rule was widely interpreted as applying only to advertising, since strict application of US Title 47 Section 315 to\u00a0news interviews on talk shows would create editorial chaos.<\/p>\n<p>That&#8217;s why the law exempts bona-fine news programs and talk shows from the rule. Historically, only a very few talk shows have applied for exemptions;\u00a0 apparently, the last two were\u00a0<a href=\"https:\/\/www.hollywoodreporter.com\/business\/business-news\/anderson-cooper-talk-show-269175\/\"> Anderson Cooper <\/a>in 2011 and a California talk show in 2006.\u00a0 These two cases were\u00a0 considered as examples of a de-facto blanket rule that left talk show editorial decisions to the broadcasters.<\/p>\n<p>What&#8217;s new is that now in 2026,\u00a0 the Trump FCC is changing the rule&#8217;s interpretation and applying pressure on CBS:<\/p>\n<blockquote><p>Concerns have been raised that the industry has taken the Media Bureau\u2019s 2006 staff-level decision to mean that the interview portion of all arguably similar entertainment programs\u2014 whether late night or daytime\u2014are exempted from the section 315 equal opportunities requirement under a bona fide news exemption. This is not the case. As noted above, these decisions are fact specific and the exemptions are limited to the program that was the subject of the request.<\/p><\/blockquote>\n<p>Attorneys with the CBS network told the Late Show with Stephen Colbert that they were running afoul of the law simply by having politicians on the show.\u00a0 Colbert says that CBS\u00a0 ordered\u00a0 him not to air an interview with James Talarico, a democratic candidate for a US Senate seat in Texas.\u00a0 So <a href=\"https:\/\/www.youtube.com\/watch?v=oiTJ7Pz_59A\">the interview was placed on YouTube,<\/a> which does not fall under the same broadcast media regulations.<\/p>\n<p>Anna M.
