{"id":84,"date":"2015-06-01T22:28:00","date_gmt":"2015-06-01T22:28:00","guid":{"rendered":"http:\/\/revolutionsincommunication.com\/law\/?page_id=84"},"modified":"2023-01-01T17:20:29","modified_gmt":"2023-01-01T17:20:29","slug":"copyright-publicdomain","status":"publish","type":"page","link":"https:\/\/revolutionsincommunication.com\/law\/copyright\/copyright-publicdomain\/","title":{"rendered":"Public domain"},"content":{"rendered":"<p style=\"padding-left: 30px;\"><strong>Students and designers a<\/strong>re often told that they must adhere to copyright laws or face legal action such as DMCA takedown orders or cease and desist letters from lawyers. \u00a0But\u00a0images, videos and recordings are\u00a0essential for individual web sites or news and information \u00a0organizations, and we need to understand what can be used without violating the law.<\/p>\n<p style=\"padding-left: 30px;\">Of course, if you generate your own work, or if your organization employs photographers or photojournalists, then the work is copyrighted and should be registered at the Library of Congress copyright office if it is valuable.<\/p>\n<p style=\"padding-left: 30px;\">In addition,\u00a0 you can a) use public domain work; b) use work licensed under the \u00a0Creative Commons (for educational \/ non-profit use); c) \u00a0make a &#8220;fair use&#8221; claim; or d) obtain permission and\/or pay a fee.<\/p>\n<p><strong>What is public domain? \u00a0<\/strong><\/p>\n<p style=\"padding-left: 30px;\">Any book, image, film or other type of recorded work created more than 95 years ago is in the public domain. So in 2021, works created in 1925 are in the public domain. Also, any book, image film or work recorded\u00a0 by the federal government is in the public domain.\u00a0 This means you are free to use them however you like.<\/p>\n<p style=\"padding-left: 30px;\">You are also (mostly) free to use any of the millions of images, videos or recordings (unless otherwise marked) \u00a0on the following sites:<\/p>\n<ul>\n<li><a href=\"http:\/\/www.loc.gov\/pictures\/\">Library of Congress<\/a>\u00a0Division of prints and photographs \u2014 \u00a0<em>many<\/em> <em>but not all<\/em> are copyright free; anything before 1926 is public domain, and of course anything by the government, including the FSA collection.<\/li>\n<li><a href=\"http:\/\/www.digitalartsonline.co.uk\/news\/illustration\/british-library-offers-over-1-million-free-vintage-images-for-download\/%20free%20images\">British library<\/a> \u2014 Millions of free images from the UK and Europe<\/li>\n<li><a href=\"http:\/\/www.openculture.com\/\">Open Culture<\/a> \u2014 Outstanding collection of free films, movies, audio files and open courses.<\/li>\n<li><a href=\"http:\/\/gallery.usgs.gov\/\">US Geological Survey <\/a>\u00a0\u2014 \u00a0Scientific photos \u00a0\u2014 geology but also plants and animals.<\/li>\n<li><a href=\"http:\/\/www.ars.usda.gov\/is\/graphics\/photos\/\">US Dept. of Agriculture<\/a> \u00a0 \u2014 Agricultural Research Service photos<\/li>\n<li><a href=\"http:\/\/digitalmedia.fws.gov\/cdm\/\">US Fish and Wildlife Service <\/a>\u2014 \u00a0Scientific photos of plants and animals.<\/li>\n<li><a href=\"http:\/\/www.usa.gov\/Topics\/Graphics.shtml\" target=\"_blank\" rel=\"noopener noreferrer\">US Government<\/a> \u2014 general collection of photos<\/li>\n<li><a href=\"https:\/\/marinelife.noaa.gov\/media_lib\/index.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">National Oceanographic and Atmospheric Administration<\/a> \u2014 \u00a0Scientific information<\/li>\n<li><a href=\"http:\/\/www.nasa.gov\/multimedia\/imagegallery\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">National Aeronautics and Space Agency<\/a> \u2014Scientific information<\/li>\n<li><a href=\"http:\/\/phil.cdc.gov\/phil\/home.asp\" target=\"_blank\" rel=\"noopener noreferrer\">Centers for Disease Control<\/a> \u2014 <b>\u00a0<\/b>Scientific information<\/li>\n<li><a href=\"http:\/\/www.motherjones.com\/media\/2016\/01\/new-york-public-library-historic-photos-archive-free\">New York public library<\/a> \u00a0\u2014 archive of 180,000 public domain photos<\/li>\n<li><a href=\"https:\/\/www.poynter.org\/news\/these-tools-will-help-you-find-right-images-your-stories\">Poynter guide<\/a> to public domain, creative commons &amp; low cost media<\/li>\n<\/ul>\n<p><strong>Creative Commons\u00a0<\/strong><\/p>\n<p style=\"padding-left: 30px;\">Any work licensed under the CC Creative Commons is available for educational and non-profit use without formal permission, so long as authorship is credited. \u00a0 Most work under the\u00a0<a href=\"http:\/\/commons.wikimedia.org\/wiki\/Main_Page\">Wikimedia Commons<\/a> \u00a0is licensed under creative commons \u00a0(CC).<\/p>\n<p style=\"padding-left: 40px;\"><a title=\"\" href=\"https:\/\/en.wikipedia.org\/wiki\/Lawrence_Lessig\">Lawrence Lessig<\/a>\u00a0and\u00a0<a title=\"Eric Eldred\" href=\"https:\/\/en.wikipedia.org\/wiki\/Eric_Eldred\">Eric Eldred<\/a> more or less invented the Creative Commons License in 2001 as a form of protection that would allow works to be available for re-use, as with works in the public domain, but also be protected from misuse of authors rights or misappropriate of original work.<\/p>\n<p style=\"padding-left: 30px;\"><a href=\"https:\/\/search.creativecommons.org\/\">Search CC<\/a>\u00a0 is a search aggregator for a dozen sites where Creative Commons image, audio and video files can be located.<\/p>\n<p><strong>Fair use\u00a0exceptions to the copyright law\u00a0<\/strong><\/p>\n<p style=\"padding-left: 30px;\">Students, authors, pundits, educators and others are free to cite <span style=\"text-decoration: underline;\">small\u00a0portions<\/span> of a work under copyright for the purposes of discussion, debate or education so long as there is no commercial value in using the portions of the work. Just how small a portion, and how little commercial value is still being worked out, and over the years, the \u201cfair use\u201d concept under Title 17 \u00a0Section 107\u00a0has eroded. In the US, the four part test of Fair Use is described in the Copyright statute and also in court cases.<\/p>\n<p style=\"padding-left: 30px;\">This can be complicated in some cases, so take a look at other information <a href=\"https:\/\/revolutionsincommunication.com\/law?page_id=41\">here<\/a> and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Fair_use\">here <\/a>before making a commercially significant fair use claim. \u00a0The four-part \u00a0\u201cfair use\u201d test \u00a0involves:<\/p>\n<ul>\n<li>the purpose and character of the use, including whether the use is commercial or for nonprofit educational purposes;<\/li>\n<li>nature of material itself<\/li>\n<li>percentage used in relation to the work as a whole; and<\/li>\n<li>effect on the market for or value of the original works<\/li>\n<\/ul>\n<p><strong>Royalty\u00a0fees\u00a0<\/strong><\/p>\n<p style=\"padding-left: 30px;\">Each individual medium has its own <a href=\"https:\/\/en.wikipedia.org\/wiki\/Royalty_payment#Copyright\">copyright royalty payment <\/a>structure. \u00a0For example, a musician who wants to play another musicians work, or record it, can do so under <a href=\"https:\/\/revolutionsincommunication.com\/law?page_id=99\">Compulsory Licensing<\/a>\u00a0by paying the fee, without obtaining the other musician&#8217;s permission.<\/p>\n<p style=\"padding-left: 30px;\">To use a copyrighted photo in a textbook, on the other hand, direct permission is needed. Often, you can simply go to the photo agency (for example Magnum or Getty), specify the type of use, and pay the fee through an online system. \u00a0For interior use in a textbook such as <a href=\"http:\/\/www.revolutionsincommunication.com\">Revolutions in Communication<\/a>, with a press run under 20,000, Bloomsbury publishers paid\u00a0less than $200 each for important photos.<\/p>\n<p><strong>Additional articles:<\/strong><\/p>\n<div style=\"width: 317px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"\" src=\"http:\/\/hyperallergic.com\/wp-content\/uploads\/2016\/07\/HoustonTexas_by_Carol_M._Highsmith.jpg\" width=\"307\" height=\"167\" \/><p class=\"wp-caption-text\">Carol Highsmith, \u201cHouston, Texas Skyline\u201d (2014), part of the Lyda Hill Texas Collection at the Library of Congress (image via Wikimedia Commons)<\/p><\/div>\n<p style=\"padding-left: 30px;\">Nov 2016 &#8212; Carol Highsmith&#8217;s lawsuit against Getty over &#8220;misappropriation&#8221; of public domain images <a href=\"https:\/\/petapixel.com\/2016\/11\/22\/1-billion-getty-images-lawsuit-ends-not-bang-whimper\/\">was dismissed from federal court.<\/a>\u00a0 Getty had offered the public domain images at standard licensing rates and then threatened Highsmith with a copyright infringement lawsuit when she used one of her own pictures.<\/p>\n<p style=\"padding-left: 30px;\">Nov 2015 &#8212; <a href=\"https:\/\/en.wikipedia.org\/wiki\/National_Portrait_Gallery_and_Wikimedia_Foundation_copyright_dispute\">European courts clarify copyright status <\/a>of centuries-old portraits in the British National Portrait Gallery, which was in a dispute with the Wikimedia Foundation.<\/p>\n<p style=\"padding-left: 30px;\">Oct 2013 \u2014 \u00a0Is copyright duration too long? \u00a0<a href=\"http:\/\/www.washingtonpost.com\/blogs\/the-switch\/wp\/2013\/10\/17\/nintendo-says-this-amazing-super-mario-site-is-illegal-heres-why-it-shouldnt-be\/\">Shouldn\u2019t Mario be public domain by now?<\/a><\/p>\n<p style=\"padding-left: 30px;\">August 2013 \u2014 On the 50th anniversary of the Martin Luther King \u201cI Have a Dream\u201d speech, most people could not hear the speech itself <a href=\"http:\/\/www.washingtonpost.com\/opinions\/why-you-wont-see-or-hear-the-i-have-a-dream-speech\/2013\/08\/27\/09d2a07a-0e66-11e3-bdf6-e4fc677d94a1_story.html?hpid=z3\">because it is copyrighted<\/a> by the King foundation.\u00a0 Some <a href=\"http:\/\/youtu.be\/smEqnnklfYs\">YouTube versions were up<\/a> on the actual 50th anniversary but probably won\u2019t be much longer.<\/p>\n<p style=\"padding-left: 30px;\">March, 2011 \u2014 Federal court invalidates agreement between Google and two academic publishing associations. The agreement was the outcome of a lawsuit initially filed in 2005 asking Google to stop scanning public domain books. Settlement discussions are continuing.
