(Photo by Kovarik)<\/p><\/div>\n<p>The authority to regulate broadcasting &#8220;in the public interest, convenience and necessity&#8221; is placed by Congress in\u00a0 <a href=\"http:\/\/www.fcc.gov\/mb\/audio\/decdoc\/public_and_broadcasting.html#_Toc197843505\">the <strong>Federal Communications Commission.<\/strong><\/a> Its most important regulatory power derives from the FCC&#8217;s\u00a0 licensing of radio and TV\u00a0 broadcasting stations and networks.\u00a0 Stations or networks who do not abide by regulations face fines and other penalties. In very rare situations, one or two have lost their broadcast licenses.<\/p>\n<p><span style=\"font-size: 14px; background-color: #ffffff; color: #444444; font-family: Georgia, 'Bitstream Charter', serif;\">The regulation involves both the structure and content of radio, television, telegraph, satellite and cable communication in the US and territories.<\/span><\/p>\n<p>Radio and TV law contains many contradictions that are essentially holdovers from regulations of a previous era.\u00a0 For example, vulgar words may get &#8220;bleeped out&#8221; on some television programs and not others. This is usually because the same programs are regulated differently depending on their venue.\u00a0 A program on a streaming channel or cable is not regulated in the same way as those that are broadcast.<\/p>\n<p align=\"left\">One trend in broadcast law is toward deregulation, but a high level of regulation is likely to remain, considering the fact that demand for the broadcast spectrum continues to exceed supply, and that (supposedly) justifies regulation under the &#8220;scarcity rationale.&#8221;\u00a0 \u00a0 Recent controversies have involved indecency on broadcast television, the structural decline of radio and cable television, and the competition with relatively unregulated new digital media.<\/p>\n<p align=\"left\">One relatively new trend is the use of federal agencies such as the FCC to punish\u00a0 political rivals.\u00a0 The Trump administration 0f 2025\u00a0 is well known for engaging in highly partisan approaches to what was once relatively neutral federal regulation.<\/p>\n<h4><span style=\"color: #000000;\"><strong>Principles of regulation have included: \u00a0\u00a0<\/strong><\/span><\/h4>\n<ul>\n<li><strong>Appropriate allocation of scarce resources (the &#8220;scarcity rationale.&#8221;)<\/strong>\u00a0 \u00a0The original reason for licensing and regulating radio (and later TV) involved the fact that the electromagnetic spectrum was relatively narrow, and the resource was\u00a0 &#8220;scarce.&#8221;\u00a0 This is less and less true. Over the years, communications channels have expanded with the advent of \u00a01) Cable networks in the 1970s; 2) Satellite systems in the 1990s; and 3) the Internet and Web in the 2000s; and 4) Digital broadcasting in the 2010s.\u00a0 As a result, the &#8220;scarcity rationale&#8221; is not as compelling as it once was,\u00a0 and the regulatory trend has been towards deregulation in most content and structural areas.<\/li>\n<li><strong>Fairness,<\/strong> once codified in the &#8220;<a href=\"https:\/\/en.wikipedia.org\/wiki\/FCC_fairness_doctrine\">Fairness Doctrine,<\/a>&#8221; is another principle. The original controversies go back to the 1920s and 30s, when the Federal Radio Commission curbed both socialist and pro-fascist broadcasting\u00a0 through licensing and the <a href=\"https:\/\/www.worldradiohistory.com\/Archive-NAB-Publications\/NAB-Code-1939.pdf\">National Association of Broadcasters code of ethics<\/a>.\u00a0\u00a0The Fairness Doctrine became official in 1949 and was upheld in the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Red_Lion_Broadcasting_Co._v._FCC\">Red Lion v FCC<\/a> case 1969, but <a href=\"https:\/\/en.wikipedia.org\/wiki\/Fairness_doctrine#Revocation\">overturned in the 1980s<\/a>. Relics of the Fairness Doctrine such as the &#8220;<a href=\"https:\/\/www.fcc.gov\/broadcast-news-distortion\">news distortion rule&#8221;<\/a> and the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Equal-time_rule\">&#8220;equal time rule&#8221;<\/a> remain in law and have become controversial in the second Trump administration.<\/li>\n<li><strong>Localism<\/strong> for radio and television stations &#8212; The idea of localism was that radio and TV stations must serve their individual communities, at least to a small extent, and not simply repeat cheap and easily syndicated studio shows.\u00a0 The &#8220;must carry&#8221; rules for cable emerged from this principle. (See FCC&#8217;s &#8220;<a href=\"https:\/\/transition.fcc.gov\/ownership\/materials\/newly-released\/localismbroadcasting.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Background on Localism in Broadcasting<\/a>&#8220;). So, too, did the decades-long process of allowing <a href=\"https:\/\/en.wikipedia.org\/wiki\/Low-power_broadcasting#United_States\">low-power community radio<\/a> over the objections of traditional broadcasters.<\/li>\n<li><strong>Universal service and neutrality<\/strong> for common carriers (telephone, internet) &#8212; Historically, telegraph and telephone companies started off in an atmosphere of cutthroat competition.
